Working Remotely

When you are active on my website or contact me you sometimes share personal data with me. I handle this data with care and comply with the applicable laws and regulations. These laws deal with the storage and use of your personal data. In this privacy statement I will explain what information I collect from you and what I do with it. This privacy statement applies to all interaction between you and Working Remotely, the method of communication does not matter. Working Remotely, located at Lessinglaan 61 in Utrecht, is responsible for the processing of personal data as stated in this privacy statement. What are personal data?

Any information that tells something about you and can be used to identify you is personal data. Examples include your name, your contact or address information and your BSN. Some of this data such as ethnicity, religion or a criminal record are special personal data.


Special personal data

I do not collect any special personal data.


Personal data of persons under 16 years of age

I do not intend to process personal data of persons under 16 years of age. However, I cannot verify whether a visitor to my websites and servers is over the age of 16. If you believe that I have collected personal information from a minor without the consent of parent or guardian, please contact me at [email protected] and, if possible, I will delete this information. If any data of persons under the age of 16 is collected by me it will always be done with the permission of his/her parent or guardian.


When do I process your personal data?

1. To be able to help you when you have questions. I am happy to help if you run into something or have a question for me. You can call me, email me or fill out a form on the website. It is also possible that I receive your information through third parties in connection with my services. In order to help you further, I store some of your information. That way I know who you are and I can find out what we talked about at the next contact moment. If you have questions for me, I will save the following information about you:

  • Your message

Legal basis: legitimate interest. 2. To prepare and send quotes to you. Before I start working for you, I may send you a quotation. For this purpose I store the following data about you:

  • N.A.W. data
  • Email address
  • Phone number
  • Company name (optional)
  • Chamber of Commerce number (optional)
  • VAT ID number (optional)

Legal basis: legitimate interest. 3. To execute an agreement, contact you for introductory talks, make notes and/or recordings of talks, make appointments with you and send you an evaluation form afterwards. When you purchase services from me, you want to be well served and receive what you have requested. I store the following data for the execution of an agreement:

  • Email address
  • Phone number
  • The other (personal) data provided by you

Legal basis: performance of the contract. 4. To be able to invoice & collect from you. The services you have purchased must of course be paid for. If you do not do this I will start a collection process. In connection with invoicing & debt collection I store the following data of you:

  • Phone number
  • Company name (optional)
  • Chamber of Commerce number (optional)
  • VAT ID number (optional)

Legal basis: legal obligation. 5. To keep you informed about changes in my services. When I make changes in my services, terms and conditions, privacy policy or other important matters, I will inform you. If you agree, I will use the following data to process you in my newsletter system:

  • Name
  • Email address

Legal basis: performance of the contract. 6. To send you my newsletters and free giveaways. If you have indicated to me that you want to receive my newsletter and the free giveaway I will store the following data from you:

  • Name
  • Email address

Legal basis: consent. 7. To register for workations and send you information related to the workations. If you have registered for a workout I will send you additional information about it (dates, times etc.). If you agree I will store the following data about you:

  • Name
  • Email address

Legal basis: performance of the contract. 8. To share your review on my website and/or social media. If you have sent me a review, I will publish it on my website and/or social media channels. If you agree to this then I will store the following data from you:

  • Name
  • Company name (optional)
  • Function / occupation

Legal basis: consent. 9. To effectively run ads and marketing. In order to effectively advertise and see how my ads are performing I use the Facebook Conversion API. When you give me permission to use the Facebook Conversion API via the cookie banner the following data may be sent from my server to Facebook:

  • Name
  • Email address
  • Phone number
  • IP address

Legal basis: consent.


Cookies and similar techniques I use

Working Remotely uses functional, analytical and tracking cookies. A cookie is a small text file that is stored on your computer, tablet or phone when you first visit a website. I use cookies with a purely technical functionality so that the website works as intended. I also use analytical cookies such as Google Analytics to study the behavior of my visitors in order to improve my website. Last but not least, I also sometimes use tracking cookies (Facebook pixel) so I can offer you customized content and advertisements. These are for example advertisers and social media companies. If I need your permission to place cookies I will ask you this during your first visit to my website. I also refer you to my cookie statement. You can opt out of cookies by setting your internet browser to stop storing cookies. As indicated earlier in this privacy statement, I use the Facebook Conversion API to be able to advertise effectively. This technique only becomes active when you agree to it in the cookie banner.


Transfer to partners

I work with various suppliers and partners to perform my services. These suppliers & partners include parties that:

  • Send my newsletters (MailerLite)
  • Handle my payments & collections (Moneybird)
  • Taking care of my web hosting & email (Wix and Gmail)
  • Doing my bookkeeping (Digitax Nomad)
  • Other programs/software I use (Google Drive)

With sub-processors, I have entered into processor agreements and/or non-disclosure agreements to ensure the security of your data. I only work with partners who can comply with the AVG legislation. Some of my partners are located outside the European Economic Area (the countries within the European Union, Liechtenstein, Norway and Iceland). Your data may be processed in America and/or other countries where these companies have their cloud storage and servers and/or backups. I have taken appropriate measures with these partners which are contractually agreed via a processor agreement / Data Processing Addendum or via a model agreement from the European Commission (click here). The stricter GDPR (the AVG) is often already signed and working by most of them. This way I make sure your data is well protected.


Transfer to third parties

In principle, I do not share or sell your data with individuals or organizations outside of Working Remotely, except with partners as described above. I may also be required to pass on your data under a legal obligation.


The security of your data

Working Remotely has taken appropriate technical and organizational security measures to protect your personal data from misuse, unlawful or unauthorized use and loss. All parties that process your data for me (sub-processors) or can see it (think employees or hired workers) sign a processing agreement or confidentiality agreement. These agreements and associated data will be kept for as long as I work with these parties.


How long will your data be kept?

I use different retention periods for different data streams. Of course, you always have the right to ask me to delete your data. See also the heading “Your rights” for this. Personal data: Name, address data, phone number and e-mail I delete 2 years after our last contact. E-mail: Email older than 2 years will be deleted unless they are still relevant to the performance of an agreement or resolution of a dispute. Invoices and quotes: Invoices and quotations may be deleted after the legal retention period of 7 years. Your data will remain in my billing system at least until then. Newsletter: You can delete your data yourself from my newsletter system at any time. Visual material: During our workouts photos and other visual material may be taken. We may use this for promotional purposes on, for example, our website or social media. We may also use this footage on partner websites. If you do not want to be visible, you must let us know in advance. Upon request, we will remove these images if you are clearly recognizable in the photo.


Your rights

You have the right to view, correct and delete your personal data. In addition, you have the right to withdraw your consent to data processing or object to the processing of your personal data by Working Remotely. You also have the right to data portability. You can send a request for inspection, correction, deletion, data transfer of your personal data or request to withdraw your consent or object to the processing of your personal data to [email protected]. To make sure that the request for inspection is made by you, I ask you to send a copy of your ID with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. If your request relates to a cookie, I ask that you include this as well. I will respond to your request as soon as possible, but no later than four weeks. Working Remotely would also like to point out that you have the possibility to file a complaint with the national regulator, the Authority for Personal Data.


Reporting a data breach

If, despite all precautions, a data leak occurs, I will comply with the mandatory data breach notification and report this leak, if necessary, within 72 hours of discovery to the Dutch Data Protection Authority. Should you discover a data leak then I kindly ask you to share this with me as soon as possible but in any case within 24 hours after you discovered the leak by sending an email to [email protected]. I can then take immediate action.


Liability

This privacy statement covers only the personal data that Working Remotely processes for the purposes of the items discussed in this agreement. Working Remotely does not accept any responsibility or liability for (the operation and/or content of) third-party websites or services.


Changes to this statement

The contents of this privacy statement may be updated at any time by Working Remotely to reflect new legislative or regulatory developments or changes within my company. You can subscribe to my newsletter where I will keep you informed of any changes. In any case, I encourage you to consult my privacy statement regularly to stay informed about my privacy policy. By continuing to use the services of Working Remotely after changes, you agree to these changes.
